How should my letter of appeal be written?
It is necessary to comprehend the reasons behind the residence office’s decision to deny your application for temporary residence before you can file an appeal. You must carefully consider the decision that was sent to you by the voivodeship office. You need to write an appeal letter expressing your disagreement with the Voivodeship Office’s decision after finding out the reasons behind their rejection of your residency application. COMPLAINT TO PROVINCIAL ADMINISTRATIVE COURT
In general, a complaint about the excessive length of administrative proceedings can be filed one day after the reminder is submitted, but personally advise you to wait 3 to 4 weeks after submitting this reminder, to give the Office time to recognize the reminder and perhaps speed up the proceedings and issue decisions in your case. If that doesn't happen, I'd recommend filing a complaint to the provincial administrative court after a few weeks. This complaint is subject to a stamp duty of PLN 100. This fee is paid to the account of the Administrative Court.
In this complaint, we enter our data, the address of the Office, the case number, we enter information on the date of applying for a residence card, information when we submitted the reminder and the fact that to date there has been no decision and we do not know the reasons why. Also in this complaint, we can submit a request to get some monetary compensation for waiting so long for a decision. These amounts, depending on the case, range from PLN 500 to PLN 2,000 or more.
The complaint is submitted, as well as the reminder, first through the Voivodeship Office where we applied.
The Office then directs the complaint to the provincial administrative court. Please remember that foreigners file a complaint to the provincial administrative court but through the Voivodeship Office. So technically this complaint is always sent to the Office, which then forwards it to the court. The important thing to remember is that this choice has ultimately been made, even if it takes a while to go from a reminder to a court lawsuit.
